1.PURPOSE. By virtue of this contract, the companies Palermo Home PALERMO HOMESAS, Palermo Home Rentals LLC and any others created under the PALERMO HOME RENTALS corporate umbrella, hereinafter referred to as PALERMO HOME, will provide accommodation to the GUEST in the unit and its accessories, in exchange for a price, for the number of days indicated in the Reservation and its corresponding Hotel Registration Card.
1.1.- The Unit will be the one indicated on the Hotel Registration Card. PALERMO HOME may change the unit if the guest accepts it and it is a unit of equal or better conditions, or in the event of a situation of force majeure.
1.2.- The check-in time is from 3:00 PM on the day of arrival and the check-out time is until 11:00 AM on the day of departure. The time period between one and the other corresponds to the hotel day. Early check-in or late check-out is subject to availability and the GUEST must pay the corresponding value.
1.3.- Accommodation will be provided regardless of the time the GUEST actually remains in the unit. Partial use results in the payment of the full rate.
1.4.- The provision of the services that are the subject of the contract and of any complementary services offered by PALERMO HOME will be subject to availability and to the schedules, shifts or physical stocks of the inputs, goods, facilities or spaces for it. The unit and the price or nightly rate will be the one indicated on the Hotel Registration Card and which corresponds to the reservation.
4.OBLIGATIONS.
4.1.- OF PALERMO HOME.
4.1.1.- Provide the service that is the subject of the contract.
4.1.2.- Attend to, receive, process and respond to suggestions, complaints or claims made by the guest.
4.1.3.- Safeguard the money and valuables that the guest has stored in the safety deposit boxes or has delivered under the terms described above.
4.1.4.- The others established in its charge by Law.
4.2.- OF THE GUEST.
4.2.1.- Identify themselves to register at PALERMO HOME with a valid identification document, presenting their national identity document or passport, or applicable document in the case of foreigners. For minors, a valid identification document must be presented.
4.2.2.- Pay the value of the accommodation plus the corresponding taxes.
4.2.3.- Pay the value of all consumption and charges that have been charged to their account.
4.2.4.- Observe a decent conduct and dress appropriately.
4.2.5.- Be responsible up to slight negligence for their obligations and those of their companions or guests.
4.2.6.- Register at the PALERMO HOME reception all the companions or guests of the GUEST who go to their unit and pay the corresponding fee or value for each of them.
4.2.7.- Respect the number of people per unit.
4.2.8.- The GUEST acknowledges that the practice of sports, physical exercises, navigation or driving of vessels or vehicles, use of instruments or tools and in general any activity that entails a risk or can be considered as a dangerous activity, will be their decision, under their sole responsibility and implies that the GUEST has the skills and knowledge to assume such risks, exonerating PALERMO HOME and its officials or employees from any liability in case they suffer any damage or injury.
4.2.9.- Use the furniture, fixtures, equipment and in general the facilities of both the unit and PALERMO HOME, in an appropriate manner, keeping them in the same condition, and therefore will be responsible for any damage or loss of the elements and assets of PALERMO HOME, up to slight negligence. In the event of total or partial loss or damage to PALERMO HOME’s property due to a cause attributable to the GUEST or their companions, the GUEST must pay the price corresponding to its repair or replacement, as the case may be.
4.2.10.- Allow the right of inspection and/or surveillance of the unit by PALERMO HOME officials. This right will be exercised in a reasonable manner and includes the power to enter or search the unit when, in the opinion of the PALERMO HOME Manager, it is necessary.
4.2.11.- Allow PALERMO HOME employees and officials access for routine tasks and cleaning of the unit.
5.TERMINATION OF THE CONTRACT.. The accommodation contract will be terminated in the following events:
5.2.- Due to non-compliance with any of the obligations of the parties, and particularly for non-payment of the price or fee owed by the GUEST, or for non-payment of food, beverages or other complementary services that the GUEST had charged to the unit or their personal account.
5.3.- In events where, at the sole discretion of PALERMO HOME, the behavior or attire of the GUEST, exhibited in public areas, threatens the tranquility and/or health of other guests or visitors of PALERMO HOME.
5.4.- For smoking in the unit or in any other smoke-free area of PALERMO HOME, when it affects other guests, visitors or users, without prejudice to the payment that must be made under the terms established below.
Paragraph: The termination of the contract does not exempt or release the GUEST from the payment of any pending balances.
6.EFFECTS OF TERMINATION.
6.1.- Upon termination of the contract, PALERMO HOME may freely dispose of the unit.
6.2.- Upon termination of the contract and regardless of the cause of termination, PALERMO HOME is authorized to enter the unit, prepare and sign an inventory of the guest’s effects and luggage, and remove them from the unit to leave them in safe and adequate custody, without liability on the part of PALERMO HOME and at the GUEST’s own expense and risk.
6.3.- If the GUEST does not pay the bill or part of it, PALERMO HOME may dispose of and sell the GUEST’s luggage and belongings under the terms of Article 1199 of the Commercial Code, to cover the outstanding obligations with the proceeds. Any excess, if any, will be made available to the GUEST. In case of a deficit, PALERMO HOME may initiate the corresponding actions to obtain full payment of the owed amount.
7.MISCELLANEOUS.
7.1.- Legal nature of the contract. In accordance with Article 79 of Law 300 of 1996, the accommodation contract is a lease contract, of a commercial and adhesion nature.
7.2.- The accommodation contract is proven by the hotel registration card issued by PALERMO HOME, accepted by the signature of the GUEST, which states that the GUEST adheres to the stipulations set forth herein. The GUEST expressly accepts that the liquid sum of money shown on the invoice will have executive merit.
7.3.- PALERMO HOME rejects and does not allow sexual exploitation or any form of sexual abuse. PALERMO HOME rejects and does not allow sex tourism or the exploitation or sexual abuse of children and adolescents. The GUEST may not bring minors under the age of eighteen (18) into their unit for sexual tourism, and anyone who does so will incur a prison sentence of 5 to 10 years and a fine of 50 to 100 monthly minimum wages. The penalties indicated in the preceding paragraph will be increased by up to one half (1/2) when the conduct is carried out with minors under twelve (12) years of age.
7.4.- Charges for smoking in the rooms. Consistent with environmental care and health, all rooms and generally all areas of PALERMO HOME are smoke-free. Smoking in the unit or in any other PALERMO HOME space constitutes a serious breach of the accommodation contract, which may result in its termination, and the GUEST may be removed from PALERMO HOME if they have affected other guests, visitors or users. If the GUEST smokes in the unit, for each day they do so, they must pay (i) the cost PALERMO HOME must incur to deodorize and clean the unit, estimated at a sum equivalent to USD 250, liquidated at the representative market rate on the day of payment, and (ii) the value of 2 nights at the corresponding rate for their accommodation, as the cleaning and deodorization process implies that PALERMO HOME cannot use the unit for the following 2 nights. If they smoke in any PALERMO HOME area other than the unit, they must pay the cost PALERMO HOME must incur to deodorize and clean the area in which they smoked, which is equivalent to USD 250, liquidated at the representative market rate on the day of payment.
7.5.- PALERMO HOME promotes compliance with Resolution 572 of 2005 and other regulations on the conservation of Flora and Fauna, as well as the conservation of cultural heritage and assets of cultural interest, and contributes to and promotes compliance with Law 397 of 1997 and other applicable regulations.
7.6.- PALERMO HOME rejects any form of discrimination, distinction, exclusion, restriction or preference based on gender, race, color, national or ethnic origin, religion, political opinion or any other reason or condition that has the purpose or effect of impairing, restricting or limiting the full enjoyment of fundamental rights and freedoms.
The GUEST, in their capacity as the holder of the personal data, will enjoy all the rights provided by law, those expressly described in Article 8 of Law 1581 of 2012, and in particular will have the right at all times to know, access, update and correct their personal data, revoke the authorization granted or request the suppression of information when appropriate.
